Order on Motion to Dismiss
MINUTE ORDER. For the reasons stated on the record at the hearing on June 11, 2024, the Court hereby GRANTS IN PART, DENIES IN PART, and DEFERS RULING IN PART on Defendants' 38 Motion to Dismiss Relators' Second Amended Complaint. The Court GRANTS the Motion as to Count III (conspiracy) of Relators' Second Amended Complaint because Relators have conceded they are not pursuing that claim. See Dkt. 39 at 13 n.7. The Court DENIES the Motion as to the non-repair and replace warranty contracts at issue in the implied false certification claim. The Court DEFERS RULING on the remainder of the Motion. Therefore, Defendants shall file an answer addressing only the non-repair and replace warranty contracts at issue in the implied false certification claim.
The Court further ORDERS that the parties shall submit a proposed supplemental briefing schedule addressing the Court's questions about the repair and replace warranty contracts.
The Court further ORDERS that on or before July 1, 2024, the parties shall confer and develop a plan to exchange the discovery material from the class action litigation in Ohio State Troopers Association, Inc. v. Point Blank Enterprises, Inc. in the Southern District of Florida. The Court will hold a video status conference on September 9, 2024, at 4 p.m. to discuss the parties' progress in exchanging such discovery and what material remains outstanding. The parties shall also come to the status conference with three proposed trial dates. On September 9, the Court will set another status conference for October 2024.
