Status Report Order 1 - Terminate Deadlines and Hearings
ORDER. The parties did not comply with the Court's 9/29/2026 Order, in that the parties did not file a joint status report as to the outcome of mediation by 10/13/2026. The parties must do so by 10/16/2026.
The parties are reminded of the deadlines as set forth in the Court's 9/29/2026 Order:
Any updates to the proposed JPTO should have been submitted in a revised proposed JPTO by 10/13/2026. As no such submission was made, the Court construes that no updates are needed. Any motions in limine are to be filed by 10/19/2026, with oppositions to be filed by 11/2/2026; no replies permitted.
Proposed joint draft jury instructions must be filed by 11/9/2026. Jury instructions need only include substantive jury instructions and any unusual instructions that a party requests. To the extent the parties do not agree on the jury instructions, they should provide a red-lined copy with their proposed alternate instructions. A Word copy of the witness list and proposed jury instructions must be emailed to scanlon_chambers@nyed.uscourts.gov. Two binders with a complete set of exhibits from each side are to be delivered to Chief Magistrate Judge Scanlon's chambers, Room 1214 via the Clerk's Office, on or before 11/9/2026. Optional pretrial briefs are to be filed by 11/13/2026; any such brief should be limited to unusual legal issues that may arise at trial. To the extent that counsel intend to use technology in their presentations, they should contact the Court's IT staff and Judge Scanlon's deputy to coordinate. They are informed that Judge Scanlon's courtroom, Courtroom 13A South, has limited computer equipment.
The parties reminded that the pretrial conference will be held in person on 11/18/2026 at 2:30 PM in Courtroom 13A South before Chief Magistrate Judge Vera M. Scanlon. Jury selection will take place 11/30/2026 at 9:30 AM in Courtroom 13A South before Chief Magistrate Judge Vera M. Scanlon. Counsel and the parties should arrive no later than 9:15 AM. At a later date, the Court will confirm the specific days on which the trial will be conducted.
