PAPERLESS ORDER: Plaintiff's First Amended Complaint ("FAC") 26 supersedes the original Complaint. Defendant First Advantage Background Services Corp.'s Motion to Dismiss 24 seeks dismissal of Count 2 of the original Complaint. The Court therefore denies the motion to dismiss as moot. Any renewed motion to dismiss shall address the claims in the FAC. Likewise, Defendant AutoNation, Inc.'s Motion to Compel Arbitration 10 addresses the claims brought against it in the original Complaint. The Court therefore denies the motion to compel arbitration as moot. Any renewed motion to compel arbitration shall identify the claims in the FAC that AutoNation seeks to submit to arbitration.
