1 - Terminate Deadlines and Hearings Settlement Conference ~Util - Set Deadlines/Hearings
Minute entry for proceedings held before Judge Gina R. Mendez-Miro. Status/Settlement Conference was held on May 14, 2024. Plaintiff was represented by Jose Carlos Velez-Colon. Co-defendant Gator Guaynabo, LLC was represented by Kenneth Suria-Rivera. Pending before the Court the following. On May 9, 2024, Plaintiff requested an extension of time to file joint motion as to the discovery dispute since the parties had not been able to meet and confer filed at Docket No. 37. The Court held this in abeyance to discuss the matter during today's conference. See Order at Docket No. 38. On May 11, 2024, Plaintiff filed a Motion for Protective Order, regarding Defendant's attempt to depose Plaintiff's Counsel, Jose Velez-Colon at Docket No. 39. On May 13, 2024, the Court issued an order holding in abeyance the protective order request to give Defendant the opportunity to respond by May 28, 2024. See Order at Docket No. 40. At the Conference, both parties reported not having discovery issues, and they have complied with the discovery deadline imposed by the Court. Regarding Gator's request to depose Counsel Velez-Colon, both counsel settled the matter prior to this conference, hence Motion requesting the Court to Order Counsel Velez-Colon to appear for a deposition, Docket No. 30, and the Motion for protective order, filed at Docket No. 39 became moot. Regarding settlement efforts, Plaintiffs made a settlement demand. Counsel Suria-Rivera presented that offer to his client, pending to be reviewed and considered. Counteroffer will be submitted at the end of this week to attempt to reach an agreement in this case. After having heard the parties, the Court allowed them until May 24, 2024 to file a joint motion informing the results of the settlement conversations. The Court encouraged both parties to intent to settle this case to avoid unnecessary costs and resources. Finally, the Court will be entering an Order setting new deadlines for the filing of dispositive motions. (Court Reporter Robin Dispenzieri.) (Hearing held in OSJ Courtroom 5.) (om)
