MINUTE ORDER issued by Courtroom Deputy G. Michel for District Judge Daniel J. Calabretta on 6/11/2024: Before the Court is Plaintiff's Response to Order to Show Cause, ECF No. 9 . Upon review, good cause having been shown, the Court DISCHARGES its 8 Order to Show Cause. Further, having been advised that this action has SETTLED as to Defendant Clearlake Waste Solutions, Inc., ECF No. 10 , the Court ORDERS the parties to file dispositional documents as to said defendant within sixty (60) days in accordance with the provisions of E.D. Cal. L.R. 160. Any hearing dates and deadlines previously set in this matter as to Defendant Clearlake Waste Solutions, Inc. are VACATED, including the hearing on Defendant's 6 Motion to Dismiss, set for 6/27/2024. The Court notes that Plaintiff served a copy of the 1 Complaint and 3 Summons on Defendant Coast to Coast Financial Solutions, Inc. on 3/18/2024. (ECF No. 5 ). To date, no further action has been taken in the case as to said defendant. Accordingly, Plaintiff shall SHOW CAUSE, in writing, within seven (7) days, why this case should not be dismissed without prejudice as to Defendant Coast to Coast Financial Solutions, Inc. for failure to prosecute.
