Minute
MINUTE entry before the Honorable Franklin U. Valderrama: The Court has reviewed the joint initial status report 62 filed by Plaintiff and Defendant Michael Vohs. The parties inform the Court that Plaintiff and Defendant Vohs have reached a settlement. By 7/15/2024, the parties are directed to file (i) the appropriate dismissal paperwork or (ii) a status report explaining the delay. Defendant Uriah Kennedy has not appeared personally or through counsel. Although the status report states that the Court "has already entered... a default judgment against Kennedy," no such order of default or default judgment has been entered on the docket. If Plaintiff intends to seek default against Kennedy, it must first file a motion for entry of default pursuant to Fed. R. Civ. P. 55(a). Plaintiff also indicates that it consents to a prove-up hearing of its default judgment damages from Kennedy before the Magistrate Judge if needed. Mailed notice. (jcm) (Entered: 05/31/2024)
