Order on Motion to Reopen Case
MINUTE ORDER denying 19 Plaintiff's Motion to Reopen Case. On October 26, 2022, the Court denied Plaintiff's Motion to Refile for Relief, ECF No. 15, which sought relief from the Court's Order dismissing this removed action for lack of derivative jurisdiction, ECF Nos. 13, 14. In denying Plaintiff's Motion to Refile for Relief, the Court explained that that motion "asserted nothing to cure the jurisdictional defect" the Court had previously identified. See Min. Order (Oct. 26, 2022). Plaintiff's Motion to Reopen Case appears to be a nearly verbatim copy of her Motion to Refile for Relief which the Court already denied. Accordingly, Plaintiff's Motion to Reopen Case is DENIED. SO ORDERED. Signed by Judge Rudolph Contreras on 6/8/2024. (lcrc1)

The parties will continue to investigate the issues surrounding the Treasury Offset Departments offset of the settlement payment, including the notices addressed to Mr. Dickerson, Mr. Dickersons address on file with the Department of Veterans Affairs, whether Mr. Dickerson lived with his father at the relevant time, and whether Mr. Dickerson received health care services from the Department of Veterans Affairs in November 2021. The government will provide any authority to the court supporting its position that the Treasury offset is not a breach of the settlement agreement.
