Law360 Canada (May 16, 2024, 2:45 PM EDT) -- Appeal by Cameron from his conviction for break and enter, possession of firearm while committing robbery, use of firearm while committing robbery and possession of cocaine. He argued that the trial judge made several errors in his Canadian Charter of Rights and Freedoms (“Charter”) ruling. A robbery took place in the early hours on a rural road near Barry's Bay, Ontario. As the police were approaching the house where the robbery had just occurred, they saw a vehicle leaving the area. The police stopped the vehicle and saw that Cameron was the driver. After briefly detaining Cameron and taking his car keys, the police arrested him. The subsequent search of Cameron's vehicle led to evidence linking him to the robbery. The police also found cocaine. Prior to trial, Cameron brought a Charter application challenging his detention and arrest. The trial judge dismissed the application and ultimately convicted Cameron....
