APPEALS — Grounds — Unreasonable verdict

Law360 Canada (June 17, 2024, 1:24 PM EDT) -- Appeal by Roebuck from his conviction for first-degree murder of MacDonald on grounds that Crown did not prove beyond a reasonable doubt his actions were planned and deliberate and verdict was unreasonable. Roebuck and MacDonald knew each other for years and became good friends. They lived within a few houses of each other. They decided to become involved together in a start-up cannabis operation. Roebuck initially said the conflict with MacDonald began when MacDonald objected to trimming the marijuana, removing the leaves from the buds, and no longer wanted an involvement in the cannabis operation. Roebuck and MacDonald engaged in a brief fistfight in a gas station. An independent witness heard Roebuck say to MacDonald, he would see him at home. Roebuck drove home, retrieved his shotgun and waited for MacDonald to arrive from the gas station. Roebuck shot MacDonald twice. Evidence of the forensic pathologist showed the shotgun was fired from about three to four feet away from MacDonald. The forensic pathologist said either wound would have been acutely life-threatening. The entire passage of time from the fight at the gas station to the shooting was approximately 11 minutes....
