Law360 Canada (July 12, 2024, 11:05 AM EDT) -- Appeal by Bakko from four-year global sentence for causing death by impaired driving and dangerous driving causing death. On January 6, 2020, Bakko drove through an intersection onto a highway while impaired (blood alcohol content of 99 mg of alcohol in 100 ml of blood). She entered the highway slowly, stopping partially in the driving lane. An 18-year-old victim struck Bakko’s vehicle from behind at 130 km/h, resulting in the victim’s death. A cellphone video was found playing in the victim’s vehicle. Bakko contended that the sentence was unfit as the sentencing judge failed to consider the victim’s own contributory conduct (speeding, possible distraction). The Crown, while conceding that the sentence was unfit, maintained that deterrence and denunciation remained primary sentencing factors for impaired driving causing death....
