A Ninth Circuit panel on Monday appeared open to narrowing the Federal Trade Commission's injunction against personal protective equipment suppliers who misrepresented the shipping times of hand sanitizer during the COVID-19 pandemic, with each judge saying the injunction's lifetime-industry ban appears to be punitive and one judge suggesting it harms consumers.
