A Third Circuit panel rejected granting a sober living facility an operating permit in a New Jersey city Friday, saying the nonprofit failed to prove that the town discriminated against it in its initial denial or that it was likely to succeed on its claims at trial.

Sober Home Brings Fight With NJ Town To 3rd Circ.
Sober living organization Oxford House Inc. told the Third Circuit that a district court overlooked evidence in its disability discrimination suit against North Bergen, New Jersey, alleging the municipality refused to sign off on the lease for an Oxford House charter within its limits.
