A Mississippi federal judge on Tuesday threw out a counterclaim filed by the family of a horse jockey who died during a fairground race alleging Philadelphia Indemnity Insurance Co. failed to adequately cover the fairground's operator because it didn't extend coverage to fairgoers, saying no such duty exists.
