    Counsel for jailed former Cendant Corp. CEO Walter Forbes pleaded with the Second Circuit Thursday to order the deposition of another former executive on the theory that the testimony could exonerate him, but the prosecution warned the effort would not only prove fruitless but also embolden others to try to reopen their cases.
