A partially split Tenth Circuit panel on Monday said a federal agency's decision to acquire land for a Native American tribe is justified, ruling that the U.S. Department of the Interior was bound under the Indian Gaming Regulatory Act's settlement-of-a-claim exception to take a 10-acre parcel into trust for a casino.

Kansas Asks 10th Circ. To Nix DOI Go-Ahead For Tribal Casino
Kansas, two Native American tribes and others have urged the Tenth Circuit to reverse a ruling upholding the U.S. Department of the Interior's decision to acquire land for the Wyandotte Nation's casino, saying the DOI had already used up funds set aside for the Wyandotte and violated its own policy in giving the project a green light.
