Fed. Circ. Finds Dueling Real Estate TMs Confusingly Similar
The Federal Circuit has backed a Trademark Trial and Appeal Board decision that refused to register a trademark on the term "Spark Living" for real estate services, agreeing with the finding that it was confusingly similar to an earlier registration.
