The Fifth Circuit has found that the Fifth Amendment does not require the City of McKinney, Texas, to compensate a woman for destroying her home while resolving a hostage situation with an armed fugitive, saying there is a longstanding exception to the takings clause for actions that are necessary in an active emergency.
