Miami-Dade County has asked a federal judge to toss a lawsuit from the operator of the Miami Seaquarium, which claimed the county is evicting it after its CEO responded to a "disrespectful" email from an official concerned about manatees held at the aging facility.

Miami-Dade County has sued to evict an aquarium from a government-owned waterfront site following reports that the operator didn't clean and maintain the 70-year-old facility well enough and repeatedly failed to care for dolphins, manatees and other animals held at the theme park.

The operator of the Miami Seaquarium is fighting an alleged attempt by Miami-Dade County to unlawfully terminate its lease, saying in a federal lawsuit it will lose $35 million from a possible eviction that occurred after the company's CEO criticized county officials in an email over the facility's condition.
