Meet The Panelists: Perils And Opportunities Of CRE Distress

The office sector is not the only commercial real estate asset class now seeing the impact of distress. The high cost of financing is also putting pressure on hospitality, multifamily, industrial and self-storage — asset classes that didn't take a hit from the turn to remote work and e-commerce, the lead drivers of distress for office and retail space.

Georgia Kromrei, senior reporter at Law360's Real Estate Authority, will moderate a discussion with four leading litigation and transaction real estate attorneys who are seeing the impacts of distress play out in each of their practices.

The panelists include Janice Mac Avoy, partner and co-head of the real estate litigation practice at Fried Frank Harris Shriver & Jacobson LLP, Anthony Mongone Jr., partner in the real estate practice at Ropes & Gray LLP, Jennifer S. Recine, partner and co-chair of the real estate litigation practice at Kasowitz Benson Torres LLP, and Dominic J. De Simone, partner and co-chair of Ballard Spahr LLP's national finance department and leader of the firm's distressed real estate team.

Mac Avoy brings extensive experience in creditor's rights, such as commercial real estate foreclosures. The Fried Frank partner and real estate litigation practice co-head focuses on complex real estate-related transactions and disputes, commercial litigation and arbitration, complex commercial landlord-tenant disputes and commercial fair market rent arbitrations.

Ropes & Gray's Mongone uses his combination of commercial real estate debt and equity experience to advise on a broad range of real estate transactions. His practice includes negotiating commercial real estate repurchase facilities, note-on-note financings, and syndication strategies for mortgage real estate investment trusts and private debt funds.

Recine is a first-chair trial lawyer who handles complex real estate disputes and disputes over distressed assets, structured products and commercial mortgage-backed securities, as well as other high-stakes matters. She often advises her Kasowitz clients on commercial real estate, land use and environmental disputes arising from the investment, development, construction, or sale of real estate assets and infrastructure projects.

De Simone also serves as leader of Ballard Spahr's real estate private credit and high-yield team and commercial loan servicing team. His real estate practice features real estate finance, transaction structuring and restructuring, and distressed real estate matters. The Ballard Spahr partner's work includes representing real estate purchasers and sellers, developers, landlords, tenants, and court-appointed receivers.
