IRS Not Liable For Viewing Taxpayer's Email, Judge Rules
A former Internal Revenue Service agent cannot be liable for violating an acquitted taxpayer's constitutional right to privacy in an investigation for income tax evasion because the alleged harm, accessing the taxpayer's emails, was performed by a private citizen acting on her own and not under the government's direction, a West Virginia federal court held Friday.
