3rd Circ. Revives Preemption Fight Over Jersey City Tax Law
The Third Circuit revived a federal preemption challenge Monday brought against Jersey City, New Jersey, over an ordinance requiring developers seeking tax breaks to observe certain labor practices, finding that because the city lacks a proprietary interest in tax-abated projects, it enforces its rules as a regulator, not a market participant.
