The Third Circuit on Tuesday declined to reconsider the dismissal of a proposed class action accusing Benecard Services Inc. of negligence after its customers and employees suffered a data breach that resulted in phony tax return money sent to thieves, according to a filing made Tuesday.

A group of Benecard Inc. employees and customers accusing the company of negligence after hackers stole their personal information and used it to create phony tax returns urged the Third Circuit on Thursday to rehear their case en banc, saying the panel undeniably misinterpreted Pennsylvania’s economic loss doctrine when it decided not to revive the suit.
