NextEra Energy Inc. cannot claim its routine disposal of nuclear fuel rods qualified as a decommissioning cost entitling it to $90 million in tax refunds from nuclear waste disposal fees the utility and plant operator paid the federal government, a panel of Eleventh Circuit judges ruled Thursday.

The federal government told the Eleventh Circuit on Tuesday that nuclear plant operator NextEra should not receive about $90 million in tax refunds for income taxes paid dating back to 1969, arguing the company couldn't claim nuclear waste disposal fees as losses under a special provision for decommissioning a plant.
