Pa. Doctrine Bars Fraud Claim Against Dick's, 3rd Circ. Rules
A split Third Circuit affirmed the dismissal of an ammunition company's claims that Dick's Sporting Goods fraudulently induced it to make and store $4.5 million worth of store-branded ammo, after the panel majority ruled Wednesday that the suit was governed entirely by the companies' vendor agreement.

Ammunitions broker Battle Born Munitions Inc. asked the Third Circuit to overturn a lower court's finding that it can't bring tort claims against its vendor Dick's Sporting Goods Inc., saying that Dick's knew it would not accept delivery of store-branded bullets when it said it would.
