Navistar International Corp. on Tuesday urged an Ohio federal court to dismiss a claim by a committee of retirees that the heavy truck and engine manufacturer is skirting an underlying settlement that resolved an earlier dispute over prescription drug benefits, arguing that the retirees have no viable claim.

The Sixth Circuit on Thursday vacated and remanded a district court's ruling that Navistar International Corp.'s conduct during an Employee Retirement Income Security Act fight invalidated the arbitration clause in an agreement with a benefit committee, saying its refusal to arbitrate doesn't constitute a waiver of the clause.

The Sixth Circuit said Friday that Navistar International Corp. violated a 1993 settlement agreement in a class action over its efforts to rein in benefits costs when it unilaterally changed prescription drug benefits for retirees in 2010, upholding a lower court ruling against the truck maker.
