Former Wal-Mart employees seeking to revive a regional sex-bias class action told the Fifth Circuit that their claims against the retailer have been effectively tolled and sufficiently differ from those recently settled by members of a onetime nationwide class that was disbanded in the U.S. Supreme Court's landmark Dukes decision.

Wal-Mart Stores Inc. told the Fifth Circuit on Monday that eight former female workers are improperly trying to appeal a sex bias case spun off of the class action that led to the U.S. Supreme Court's landmark 2011 Dukes ruling, arguing the district court didn't give them permission to intervene.

Eight former female Wal-Mart Stores Inc. employees, who were not parties to a recent settlement between the retailer and named plaintiffs originally covered by the nationwide Dukes class that the U.S. Supreme Court disbanded, on Monday asked the Fifth Circuit to allow them to continue to pursue sex bias claims on a classwide basis.
