A whistleblower on Friday pushed the Fifth Circuit to uphold a $663 million False Claims Act judgment over Trinity Industries Inc.'s allegedly defective guardrails, saying that a federal agency's decision in 2014 to let the guardrails stay on the market isn't relevant to whether the company committed fraud.

Trinity Industries urged the Fifth Circuit on Monday to reverse a $663 million False Claims Act judgment over allegedly defective guardrails, saying a Texas federal court wrongly ignored a June 2014 Federal Highway Administration statement that the company's metal barriers complied with federal safety standards.
