A telecommunications consultant asked the D.C. Circuit on Friday to revive his False Claims Act lawsuit filed over Verizon Communications Inc. subsidiaries' billing practices, arguing a federal judge incorrectly determined that his suit was barred by the FCA's first-to-file rule.

Verizon Wireless urged the D.C. Circuit on Wednesday to dismiss a False Claims Act suit the company said repeats allegations the same telecommunications consultant already brought, saying the second suit was filed while the first was still pending, in violation of the statute.
