A Toyota dealership told the D.C. Circuit on Friday that no deference should be given to the National Labor Relations Board’s order invalidating its mandatory arbitration policy preventing workers from pursuing class actions, because the board didn't properly yield to other federal statutes.

A group of seven labor law professors on Friday pushed the D.C. Circuit to side with the National Labor Review Board in its fight over a mandatory arbitration policy used by a Toyota dealership and find that a provision in the agreement barring workers from pursuing class litigation is illegal.

The National Labor Relations Board has urged the D.C. Circuit to enforce its order invalidating a California car dealership's mandatory arbitration policy because it precludes employees from pursuing class action claims, pointing the appellate court to the Seventh Circuit's ruling last week that concluded class waivers are illegal.
