The U.S. Supreme Court on Monday told the Ninth Circuit to rethink an en banc ruling making it harder for businesses to justify paying women less than men, saying the appeals court should not have counted the vote of the ruling's author, Judge Stephen Reinhardt, because he died before the decision was issued.
