The Seventh Circuit declined on Monday to weigh in on whether a union should be required to represent public employees who do not contribute to the union, shutting down an Illinois engineering union's suit as premature but noting that it doesn't have a "losing position."

A Seventh Circuit judge on Tuesday said he was concerned that an Illinois engineering union arguing that it should be exempted from exclusively representing nonmembers in grievance proceedings was simply asking the court to issue "an advisory opinion," in the absence of a more detailed claim.
