The Tenth Circuit has refused a Christian school's bid for full court review of a decision letting a former teacher's race discrimination suit move ahead, over a dissent from four judges who said an exception to federal bias law for ministers should preclude the case.

Trial court decisions rejecting employers' attempts to invoke a carveout to federal bias law called the "ministerial exception" can't be immediately challenged, a split Tenth Circuit ruled, shutting down a Christian school's bid to press a quick appeal in a former teacher's race discrimination suit and leaving whether he qualifies as a minister up to a jury.
