The Tenth Circuit said Monday it won't revive a former letter carrier's suit accusing her union of negligence for incorrectly telling her she couldn't file a discrimination charge with the U.S. Equal Employment Opportunity Commission while pursuing a union grievance, ruling federal labor relations law preempts the claim.
