The Eleventh Circuit has rejected a bid from a doctor who requested to have his suit reheard for the third time in a case he filed against the U.S. Department of Veterans Affairs alleging the agency did not grant him employment because of his age, gender and prior employment dispute.

A doctor suing the U.S. Department of Veterans Affairs over alleged hiring discrimination has asked the Eleventh Circuit to hear his case for the third time, arguing that the full court should find he is allowed to prove his claim using circumstantial evidence.

The Eleventh Circuit said Tuesday it won't reopen a doctor's suit alleging that he didn't receive a position with the U.S. Department of Veterans Affairs because of his age, gender and prior employment dispute, ruling he hadn't demonstrated these factors played a part in the VA's decision.
