An Eighth Circuit panel failed to tackle an intra-circuit split over pleading requirements for Equal Pay Act cases when it ruled that a former consulting company manager was paid less than a male co-worker because of her experience, the worker said, urging the full court to intervene.

The Eighth Circuit affirmed a consulting company's win over an ex-manager's suit alleging she was paid $75,000 less than a male co-worker, ruling Wednesday the company had proved the disparity was based on her co-worker's experience level rather than bias.
