The D.C. Circuit granted a bid Tuesday from the NLRB and a hotel operator to toss the agency's request to enforce a board decision over the size of a bargaining unit and the company's petition for review of the ruling, after the operator and a UNITE HERE local reached an agreement.

National Labor Relations Board attorneys told the D.C. Circuit that its December decision correctly ruled against a hotel's contention that three units of housekeepers, food service workers and front desk clerks should be lumped into one bargaining unit, saying evidence supports the board's analysis on remand.

A Chicago hotel operator that convinced the D.C. Circuit in 2020 to reverse a National Labor Relations Board ruling letting its housekeepers and food service workers form separate unions without its front desk clerks has asked the court to reverse the board's redo ruling upholding the initial outcome.
