The Sixth Circuit on Friday revived a lawsuit a group of union benefits funds brought against a Michigan contractor over unpaid contributions they claim they were owed under a labor contract, saying a lower court prematurely determined the work at issue was not covered.

At least one Sixth Circuit judge seemed skeptical Wednesday of a Michigan industrial labor supplier's position that it could use nonunion workers for certain machine repair jobs, after several union funds said the company owed them millions for work covered by a collective bargaining agreement.
