The Second Circuit refused Thursday to reinstate a suit from a former cake decorator who said she was fired for requesting sick leave to deal with a suspected case of COVID-19 in early 2020, saying she did not show that she experienced a severe health condition.

Food company Rich Products urged the Second Circuit not to bring back an ex-cake decorator's suit alleging she was fired for requesting sick leave for a suspected COVID-19 illness, arguing that she had not proved she was severely ill and that she had chronic attendance issues predating the leave request.
