Law360, New York ( November 25, 2015, 10:50 AM EST) -- Last month, in what may herald a new approach to enforcement, the Federal Aviation Administration announced the largest civil penalty ever levied against an operator of unmanned aircraft. The FAA proposed a $1.9 million civil penalty against SkyPan International Inc. of Chicago. In terms of the target and the amount of the penalty, the FAA is sending a clear message of deterrence against any noncompliant unmanned aircraft operations. Unlike certain prior enforcement scenarios, the FAA targeted a relatively long-standing and established operator — an operator the FAA has since authorized to use unmanned aircraft — and the FAA did not articulate egregious examples of careless or reckless flying through this enforcement action....
