MINUTE entry before the Honorable Jorge L. Alonso: The parties have filed a stipulation to dismiss this case with prejudice, with the Court to retain jurisdiction in certain respects. The Court is concerned that these terms of dismissal are inconsistent with certain Seventh Circuit case law. Counsel should review Dupuy v. McEwen, 495 F.3d 807, 809-10 (7th Cir. 2007), Shapo v. Engle, 463 F.3d 641, 643 (7th Cir. 2006), and Blue Cross & Blue Shield Ass'n v. American Express Co., 467 F.3d 634, 636 (7th Cir. 2006), and the cases cited therein. Counsel may also wish to review the article, "What's an Attorney to Do? Ensuring Federal Jurisdiction Over Settlement Agreements in Light of Recent Seventh Circuit Cases," by Judge Morton Denlow (Ret.), which discusses this case law and provides sample dismissal orders. By 9/11/26, the parties may file a revised stipulation and/or a memorandum explaining why their stipulation meets the requirements set forth in the above-cited case law. If they file nothing, the Court will enter the parties' proposed dismissal order as drafted, except that it will change the dismissal to one "without prejudice."
