DC Circ. Stokes Nuclear Energy Insurance Issues

Law360, New York ( December 11, 2013, 4:35 PM EST) -- Two recent actions, one from the United States Court of Appeals for the D.C. Circuit, and another from the Nuclear Regulatory Commission, have resumed the process of considering a disposal facility for spent nuclear fuel and other radioactive waste in Yucca Mountain, Nev. While these decisions provide no assurance that Yucca Mountain will eventually be licensed and constructed, they do raise the question once again of a national disposal facility for spent nuclear fuel in the U.S. The presence of such a facility could drastically change the financial concerns of nuclear power plant owners, including the types and amounts of insurance that owners purchase to protect these facilities....
