Law360, New York ( May 9, 2014, 10:17 PM EDT) -- During oral argument in Alice Corp. Pty. Ltd. v. CLS Bank International, several U. S. Supreme Court justices asked a simple question: Why aren't the Alice claims abstract? Unfortunately, counsel did not provide a lucid answer to that question a question that speaks to the heart of the issue in the case. There is a straightforward and simple answer to this fundamental question, however, and we feel it is imperative for someone to speak out and provide that answer, which we will do here. . . .
