ACA Contraception Accommodations May Not End Strife
Law360, New York ( September 4, 2014, 12:16 PM EDT) -- The U.S. Department of Health and Human Services and U.S. Department of Labor answered the most recent court challenges by conservative religious groups to the Affordable Care Act's requirement that employer plans include contraceptive coverage without cost-sharing as a preventive services benefit. On Aug. 22, 2014, the agencies released proposed and interim final rules that extend the accommodation available to nonprofit religious corporations to closely held for-profit corporations and reduce the involvement of objecting employers in arranging for their employees' contraceptive coverage from other sources. It remains to be seen whether these accommodations will satisfy the religious groups or tip the balance in the courts considering the challenges filed by these groups....
