Not All Antitrust Auto Parts Cases Are 'Auto Parts Cases'
Law360, New York ( September 9, 2014, 10:13 AM EDT) -- Recent media reports have detailed competition law actions by Chinese and Indian authorities involving auto parts. Some headline writers (and perhaps less-than-careful readers) have confused these actions for merely additional steps in the long-running multinational auto parts investigations. But, those familiar matters concern alleged anti-competitive horizontal agreements among parts suppliers when they sold parts to vehicle manufacturers (also known as original equipment manufacturers or OEMs). These new Chinese and Indian actions target the OEMs themselves for alleged abuses of dominance in the pricing and distribution of replacement parts. These new actions illustrate both the workings of the replacement parts industry as well as some differences in enforcement priorities between these authorities and their U.S. counterparts....
