Moreover, the means to that end involved slapping down for the second time in the same matter a decision by the Ninth Circuit Court of Appeals holding that such a claim was valid. Also, the court expressed frustration that a lower court had ignored the standards established in a prior decision by the court, a telling message that extends beyond the four corners of this one decision....
