A Look Back At A Year Of Record-Setting HIPAA Enforcement

With 2016 behind us, we take stock of what was a historically busy year in Health Insurance Portability and Accountability Act enforcement. In 2016, the U.S. Department of Health and Human Services in conjunction with its Office of Civil Rights blew away prior HIPAA enforcement activity. Last year saw unprecedented levels of enforcement actions, fines and, as a result, aggregate HIPAA penalties being assessed. In addition to increased enforcement activity, HHS released significant guidance on, among other things, cloud computing and ransomware attacks. The HIPAA year was also marked by HHS' launch of phase 2 of its "HIPAA Privacy, Security and Breach Notification Audit." That audit is well underway, and we should begin seeing some of the results in 2017....
