By Lisa Blue and Robert Hirschhorn ( August 11, 2017, 12:10 PM EDT) -- The greatness of a federal district court judge should be measured by their devotion to giving litigants a completely fair trial and not just a constitutionally required fair trial. The Sixth and Seventh Amendment guarantees of a fair trial should encourage if not outright compel federal judges to exercise their discretion under Rule 47 of the Federal Rules of Civil Procedure and Rule 24 of the Federal Rules of Criminal Procedure, and allow attorneys a meaningful opportunity to enhance and participate in what is arguably the most important part of the trial by jury process — jury selection. From the Judge's perspective, what needs to be balanced is obtaining meaningful information to determine a juror's ability to truly be fair and impartial versus reasonable judicial efficiency....
