Over that amount of time, it is no surprise that clients and counsel alike form strong opinions about the opposing trial team, their witnesses and their experts as a result of the countless interactions that occur between the parties. In most cases, these views are based on adversarial exchanges such as a deposition and/or court appearances when the parties are not necessarily "jury ready." As a result, counsel may understandably assume that their impressions of opposing counsel or of a particular witness will be shared by trial jurors. We have found that, often, that is the farthest thing from the truth....
