PCD To Use Carmack In $7.7M Suit Over Lost Phones
A federal judge has thrown out California state law claims against Platinum Cargo Logistics Inc. and Celestial Freight Solutions LLC brought by Personal Communications Devices LLC over the loss of a $7.7 million shipment of cell phones, ruling that they are preempted by the 1906 Carmack Amendment to the Interstate Commerce Act of 1887.
