IndyMac Bancorp Inc.'s bankruptcy trustee is asking the Ninth Circuit to scrutinize a recent ruling that closed the door to $80 million of coverage for securities lawsuits targeting former IndyMac directors and officers, according to an appeals notice posted Friday.

A California federal judge refused Wednesday to open up a second $80 million set of insurance policies to cover securities litigation against former IndyMac Bancorp Inc. directors and officers, a ruling insurers in other coverage disputes likely will cite in arguing for broad interpretations of what makes claims interrelated enough to be covered under only one policy period.

FDIC Can't Intervene In IndyMac Coverage Suit: Judge
A California federal judge on Wednesday said the Federal Deposit Insurance Corp. cannot intervene in a declaratory judgment suit brought by insurers of IndyMac Bancorp seeking to avoid paying defense coverage for company executives in lawsuits stemming from the bank's collapse.
